This text is a translation, provided for information purposes. Only the original French version is authoritative: in the event of any discrepancy, it shall prevail.
These general terms and conditions (hereinafter the “TERMS”) set out the conditions for the provision and use of the services of the randraw.studio site (hereinafter the “SITE”).
The SITE is created, developed and operated by Philippe BILLAULT, Saint-Ouen, France, SIRET 414 032 383 (hereinafter the “PUBLISHER”). See the legal notice.
Visitors who do not sign up are referred to as VISITORS. Members, who sign up on the SITE and leave their contact details there, are referred to as ORGANIZERS, in the sense of the organizer of an event. People who take part in an event, on their phone or at a kiosk, are referred to as PARTICIPANTS.
These TERMS apply without prejudice to the applicable statutory provisions, in particular those of the French Consumer Code.
The SITE enables an ORGANIZER to run an event (prize draw, raffle draw, bingo, quiz, competition…) on a big screen, while the PARTICIPANTS play from their phone or a kiosk. The SITE's public previews make it possible to discover each activity without signing up.
The PUBLISHER provides a tool. It organizes no game, collects no stakes, holds no prizes and no funds, and is not a gambling service.
The ORGANIZER is solely responsible for ensuring that their event complies with the law of their country, in particular if they charge a fee to play, sell bingo cards or award prizes. It is up to the ORGANIZER to make the necessary inquiries before organizing their event.
Using the SITE for gambling or betting without the authorization required by law is prohibited.
The bingo cards produced by the SITE are not approved charitable gaming equipment.
No account is needed to discover the previews. To organize an event, an ORGANIZER account must be created with an email address and a password, or with a Google account. The email address must be verified, and the first name and last name must be provided.
The ORGANIZER undertakes to provide accurate information and to keep it up to date. The PUBLISHER may check the accuracy of this information, and may refuse to activate, or may deactivate, an account whose information is incomplete, incorrect or fraudulent.
The ORGANIZER must protect their login credentials. The PUBLISHER is not liable for the use of an account by a third party to whom the ORGANIZER has disclosed their credentials, or who has obtained them through the ORGANIZER's fault or negligence. The ORGANIZER must not use another ORGANIZER's account. Two-factor authentication is offered to strengthen the security of the account.
The SITE offers the Discovery plan, free of charge and with no time limit; the Essential plan, on an annual subscription; the Pro plan, on an annual subscription, with a choice of server region; and the Premium plan, tailor-made.
The details of each plan (limits on participants, events and images, features included) and the prices are set out on the Pricing page. Prices are stated inclusive of all taxes, in the currency displayed.
Payment is made online, on a form managed by Stripe, which acts as merchant of record: it takes the payment, collects and remits the taxes, and handles the fraud, disputes and support relating to payment (see Our data processors).
The Essential and Pro plans are annual subscriptions, renewed automatically each year until they are canceled. The ORGANIZER can find their invoices and manage their card from the billing portal accessible in their account.
The ORGANIZER may cancel their subscription at any time from their account. Cancellation stops the renewal: access to the plan remains open until the end of the current period, and the ORGANIZER may resume their subscription as long as that period has not ended. Cancellation does not give rise to an automatic refund of the current period. In the event of a full refund of a purchase, the subscription is not renewed, and access to the plan may be cut off without waiting for the end of the current period.
The ORGANIZER may close their account at any time from their account area. The deletion period and what happens to the data are described in the account data protection policy.
If the ORGANIZER is a private individual (a natural person who is not acting for the purposes of their professional activity), they have 14 days from the date of their order to withdraw, without having to give any reason.
To withdraw, they must write to us within that period through their account's support, stating their order: this is what assures us that the request does indeed come from them. We refund them within the following 14 days, using the same means of payment. Their subscription is not renewed, and access to the plan may be cut off as soon as the refund is made.
The ORGANIZER is solely responsible for what they enter and publish with the SITE: names, texts, questions, images, prizes. In its capacity as hosting provider for the service, within the meaning of French Law No. 2004-575 of June 21, 2004 on confidence in the digital economy, the PUBLISHER is not liable for this content, over which it exercises no prior control.
The ORGANIZER undertakes not to publish any content that:
This list is not exhaustive.
The ORGANIZER is responsible for the personal data of their PARTICIPANTS, as detailed in the participant data protection policy. The ORGANIZER undertakes not to collect sensitive data.
If the ORGANIZER uses the SITE in breach of these TERMS or of the law, the PUBLISHER may take their content offline immediately. At the request of a legitimate authority (court, administrative authority, police), the PUBLISHER may provide the information that makes it possible to identify the ORGANIZER.
The PUBLISHER is not liable for the content published by ORGANIZERS, nor for disputes between individuals following an event organized with the SITE.
The PUBLISHER cannot guarantee the quality of the Internet network or the absence of service interruptions. The smooth running of an event also depends on the network at the location, on the PARTICIPANTS' devices and on their browser.
ORGANIZERS, PARTICIPANTS and VISITORS are invited to report to the PUBLISHER, through the contact form, any fraudulent use of the SITE and any content contrary to these TERMS or to the law. The report must describe the facts and their precise location on the SITE, and state the grounds on which the content must be removed, together with the applicable legal provisions.
As soon as it becomes aware of the manifestly unlawful nature of any content, the PUBLISHER may remove it or make access to it impossible, in accordance with the law.
The general structure of the SITE is the exclusive property of the PUBLISHER, or is the subject of a license of use granted for its benefit. Any reproduction or representation, in whole or in part, of the SITE or of its components, without the express authorization of the PUBLISHER, is prohibited and would constitute an infringement punishable under Articles L. 335-2 et seq. of the French Intellectual Property Code.
Any hypertext link to the SITE that uses the technique of “framing” or “in-line linking” is prohibited.
The PUBLISHER may develop its services, by adding features or by modifying those it offers.
The PUBLISHER may amend these TERMS. It informs each ORGANIZER by email, at the address of their account, at least one month before the amendment takes effect. If the ORGANIZER does not accept it, they may close their account from their account area. Failing that, the new terms and conditions apply no earlier than one month after receipt of the notification.
VISITORS may write to the PUBLISHER through the contact form or share their ideas through the form provided for that purpose. ORGANIZERS may also contact support from their account. The PUBLISHER replies within a reasonable time, depending on the urgency of the request, without being able to guarantee a specific time frame.
If any provision of these TERMS is held to be invalid or unenforceable, the other provisions remain applicable.
These TERMS are governed by French law.
Consumer mediation concerns private individuals only: a natural person who organizes an event outside their professional activity. Before any mediation, an ORGANIZER who is a private individual must first contact us, through the contact form or through their account's support: the law requires the private individual to have first attempted to resolve the dispute directly with the PUBLISHER, by means of a written complaint. We then seek an amicable solution with them.
If this complaint has not received a satisfactory response, the ORGANIZER who is a private individual may then refer the matter, free of charge, to the consumer mediator: the CM2C (Center de la médiation de la consommation de conciliateurs de justice), www.cm2c.net. They may file their dispute there online.
In the event of a dispute, the parties shall seek an amicable solution before any legal action. Failing that, and subject to the mandatory rules that protect consumers, the competent courts of Paris shall have exclusive jurisdiction.
